Tax court: Mass. woman can deduct sex change

Source: In this article Rhiannaon O' Donnabhain was born a man and had a gender-reassignment surgery and tried to file it on her taxes. The IRS denied her and she sued them in 2007; saying the surgery was not medically necessary. Quote "A gay-and-lesbian group told the press the ruling could affect thousands of tax filers every year."

 I was completely hurt by this article! Are you serious? Where is this nation headed?

 If she/he wins; what does that do for every other cosmetic surgery that happens? "Yes, I got a boob job done and I would like it taken off my taxes. Thank-you!" No, way. This case holds a lot of weight. Because if we let this pass; it leaves the door open to every nose, boob, botox, and more to be claimed at income tax time.

I am sorry, I can not believe this to be ok. This is not a surgery he could not live without. This surgery was a choice right along with nose jobs and everything else. I would be ok if the surgery was medically necessary' but it was not. By the way I do not have a boob job, was just using it as a good example.

  3. Well, thanks for clearing up the question that you don't have a "boob job!" I thought it was funny when you mentioned "boob job" and that the case "holds a lot of weight."

    You know, it all comes down to the genetics/choice issue. If a person believes that they were born female, but got stuck inside a male body, then of course this is a necessary surgery. But, if you believe that God doesn't make mistakes, then this is just an excuse so that you don't have to pay for your surgery. In this case, I think it's just a bunch of crap!
    But you're right, this could bleed over into millions of dollars of un-needed surgery, and tax payers would have to foot the bill. (which would be funny if it was foot surgery.) We cannot allow this to happen! Do me a favor? Keep me abreast of the situation? Sorry. It slipped out.

  4. You make very good points. I know there are a lot of people in the world that try to "cheat the system." I understand we all need a break sometimes and work hard for our money; we deserve more than what we get back. I would agree that it is wrong to try filing a surgery that is not necessary.
